In response to a letter from the Ministry of Economy, the AMCU noted that the transfer of the seized assets of the companies that developed the Sakhalin field (PrJSC MC Ukrnaftoburinnya, LLC Sirius-1, LLC Sakhalinskoye, and LLC East Upstream Petroleum) to the management of PJSC Ukrnafta is recognized as a concentration and requires the AMCU's approval.

As stated in the AMCU's resolution, "the legislation on protection of economic competition does not provide for any other exceptional conditions for granting a merger clearance or an exception to the need to obtain it, including under a special procedure. According to Article 22 of the Law, these actions are recognized as concentration". In other words, a concentration that requires the AMC's approval is prohibited until the approval is granted.

Time and the decision of the Cabinet of Ministers will show whether we should expect another state monopolist with another violation of the current legislation...

Як зазначено в резолюції АМКУ - «законодавством про захист економічної конкуренції не передбачено жодних інших виняткових умов надання дозволу на концентрацію чи винятку щодо необхідності його отримання, у тому числі за особливою процедурою. Згідно статті 22 Закону зазначені дії визнаються концентрацією». Тобто, концентрація, яка потребує дозволу АМКУ, забороняється до надання дозволу на її здійснення.
 
Час і рішення Кабміну покаже чи чекати нам ще одного державного монополіста з черговим порушення чинного законодавства…
