The court also concluded that the challenged provisions of the Law "On Enforcement Proceedings" and the Law "On Compulsory State Pension Insurance" constitute a failure by the state to fulfill its positive obligation to ensure minimum social protection.

Цим рішенням КСУ визнав неконституційними приписи частин законів "в тім, що вони унеможливлюють виплату – у розмірі не нижче прожиткового мінімуму пенсії, що є основним джерелом існування, призначеної в установленому законом розмірі прожиткового мінімуму".

Суд також дійшов висновку, що оспорювані приписи закону "Про виконавче провадження" і закону "Про загальнообов’язкове державне пенсійне страхування" є невиконанням державою свого позитивного обов’язку забезпечити мінімальний соцзахист людини.

У пресслужбі суду додали, що текст рішення та його резюме будуть опубліковані 23 березня.
